This Writ Petition, r,rnder Article 226 of the Constitution^of India, is filed seeking the following relief:

It is the case of the petitioners that the property situated at Bahadurpally Vitlage was originally granted to Late Smt. Raliunnisa Begum, W/o Late Sri Nawab Shamsheer Jung Bahadur, who applied to the Nazim Atiyat for granting Muntakhab. It is further case of the petitioners that an Inam enquiry was conducted into the claim of Rahunnisa Begum, in File No.4/56/58 sub-file No.lO in the office of the Nazim Atiyat, Revenue Department, erstwhile Government of Andhra Pradesh, Hyderabad and the Nizam Atiyat vide order dated 28- 1O- 1968 conhrmed the grant for the

Bahadurpalli village and aggrieved by the same, the said Rafiunnisa Begum preferred appeal to the Board of Revenue to the extent of not sanctioning grant for Bahadurpalii Vil1age. It is further case of^the petitioners that the Board of revenue by an order dated 29-12-1976 in File No.NA2/78l1969 set aside the order dated^28-10-1958 passed by the Nazim, Atiyat and allowed the appeal and confirmed the grant for Bahadurpatli Viilage but the^{authorities concerned} failed to implement the same by mutating the^{revenue records or} restoring possession. It is also case of the^petitioners that^{due to} inaction of the respondents, third^parties are^{encroachinguponthe} property by creating lictitious documents and asserting^false claims. The grievance of the^{petitionersis that theyhave submitted} several representations dated^{09 .O1.2O23} and^{L9 .O7 .2023 to the} respondents to implement the orders of the^{orders dated 29-12-} 1976, passed in File No.NA2 /78/1969,^{by t1 e Board of Revenue,in} respect of the property situated at Bahadurpally^Village, Qutubullapur^{Mandal,Ranga Reddy District but till dateno action} has been taken.

Admittedly, the Board of Revenue,^{has passedordersdated} 29.12.1976 in Fiie No.NA2l78l1969^{and the petitionershave not} obtained any succession certificate^{from the competent civil Court} to claim the lands belonging to^{Late Smt. Rafiunnisa Begum.By}

relying on the^{decisiontaken by the Boardof Revenue in the year} 1976, ir is not^{possiblefor the revenue authorities to decide the} sr,rccession^{rights and mutate the namesin the revenue records and} consequently,^{issuepattadarpassbooks.}

In view of the above,^{this Courtwithout going into the merits} of the case,^{deems itappropriatelo relegatethe petitioners lo} approach the competent^{Civil Court, in accordance with law and} establish their^{succession rights in respectof the propertvin} question as the successors-in-interest^{of Late Rafiunnisa Begum' In} the event of obtaining^{such declaration,if any, from the competent} Civil Court, the revenue^{authorities are directed to examinethe} claims of the^{petitioners herein strictly in accordancewith law, by} issuing notice to all the^{persons whose names are alreadyrecorded} in the revenue records^{and pass appropriate orders,in accordance} with law.
