Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ of Mandamus dectaring the order passed by Respondent No 2 in file No 8/9216/08 dt. 16-2-2009 as arbitrary, iilegat and violative of Article 14,19(1Xg) 21 and 300-A of the Constitution of lndia apart from being violative of the directions issued by this Hon'ble Court in WP NO 242 ot 2OOB and the orders issued in W.A.No.15B9, 1590 and 1591 of 2008 and consequently also hold that the Respondent No.1 has no authority or jurisdiction to entertain the appeal as held by this Hon'ble Court in a reported Judgment reported in 2009(1) ALD, page 248, in which learned single judge also referred to and relied upon reported judgment of this Hon'ble Court reported in 2005(2) ALD, Page 419.
