"This Honble Court may be pleased to issue a Writ or Order more particularly one in the nature of Writ of Certiorari caJling for records pertaining to credit facihties provided to the 2"d respond.ent company by the 1st lespondent Bank being maintained by it leading to issuance of impugned notices viz., (i) Demald Notice dated 23.O1.2019 issued under Section 13(2) of Securitization and Reconstruction of Financia.l Assets arrd Enforcement of Security Interests Act, 2QO2 (for short SARFAESI Act); (ii) possession notice issued under Section 13(4) of SARFAESI Act, dated 31. 10.2019; (iii) 30 days prior notice under Rule 8(6) of Security Interest {Enforcement)Rules,2002, dated 18.06.2020; and (iv) e-Auction Sa-le Notice dated 30.07.2020; and (v) another e-Auction sale notice dated 17.03.2021 are i1lega.l, arbitrary, erroneous, void and nonexercise of power and jurisdiction vested in by the 1s! respondent Bank under the provisions of SARFAESI Act, being u n constitutional and are in violation of Article 19 and 300-A of the Constitution as much as against the provisions of Article 137 of Limitation Act, 1963 a:rd under Section 36 ol SARFAESI Act,2OO2 and the Rules framed thereunder and consequently declare those notices as null and vord being invalid and unenforceable, in so far as the properties of the Petitioner and his late Mother as detatled in Schedule-B properties of the Demand Notice issued U/Section 13(2) of SARFAESI Act,2OO2, and Lot A, Lot B, Lot C properties of Sale notice for e-auction dated 17.03.2021 issued by the 1o respondent."
