ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. Challenging the action of the 2^nd respondent in rejecting the mining lease application of the petitioner dated 13.02.2004 vide Memo No.2769/M.I(1)/2008-1, dated 20.09.2008, the present writ petition was filed.

3. The impugned memo states that a show cause notice dated 19.08.2008 was stated to have been issued to the petitioner before issuing the above memo. Learned counsel for the petitioner submitted that, to the said show cause notice, the petitioner submitted reply on 25.09.2008 and without considering the same, the impugned memo was passed.

4. Both the counsel submits that, in identical matters in W.P.No.23985 of 2008 and batch, this Court by order dated 05.12.2012 disposed of the writ petitions by directing the respondents to consider the case of the petitioners afresh by considering the explanation submitted in pursuance of the show cause notice and after giving sufficient opportunity of being heard within a period of two months from the date of receipt of the said order.

In view of the said order, this writ petition is also disposed of directing the respondent to consider the application of the petitioner afresh after considering the explanation dated 25.09.2008 submitted by the petitioner, and after giving an opportunity of hearing to the petitioner within a period of two months from the date of receipt of a copy of this order. No order

as to costs.

Miscellaneous petitions, if any pending in this writ petition,

shall stand closed.
