This Criminal Petition is filed to quash FIR in Crime No.244 of 2012 of Addanki Police Station, Prakasam district, for alleged

offence under section 420 of IPC.

¶17

2. Heard both sides.

¶18

3. Advocate for petitioner submitted that entire allegations in the FIR are civil in nature and there are exchange of notices between the parties and it would only attract breach of contract. He submitted that defacto complainant having not come forward with the balance sale consideration gave complaint to the police only to harass the petitioner.

4. I have perused the material papers filed along with this criminal petition.

5. On a perusal of the material papers, I am of the view that without going into merits of the case, directing police to proceed with the investigation without making arrest of the petitioner, this criminal petition can be disposed of.

6. Accordingly, this Criminal Petition is disposed of directing the Police to expedite investigation as early as possible and complete it without arresting the petitioner till completion of investigation or filing final report in the above crime.

7. As a sequel, miscellaneous petition if any, pending in this

criminal petition shall stand closed.
