O R D E R:
This Criminal Petition is filed to quash proceedings in
SC.No. 486 of 2012 on the file of Asst. Sessions Judge, Sircilla, Karimnagar district for alleged offences under section 366 read with section 109 IPC.
2. Heard both sides.
3. Learned Public Prosecutor submitted that according to his instructions, the matter is at the stage of Investigating Officer’s examination in the year 2012 and thereafter it could not be proceeded on account of this criminal petition.
3. I have perused the material papers filed along with this
criminal petition.
4. Considering the nature of the case and gravity of offence, I feel without going into the merits of the case, giving liberty to the petitioner to urge all these grounds before trial court and directing the trial court to expedite trial of SC.No. 486 of 2012 this petition can be disposed of.
5. Accordingly, this criminal petition is disposed of directing
the Assistant Sessions Judge, Sircilla, Karimnagar district to dispose of SC.No. 486 of 2012 as expeditiously as possible preferably within six months from the date of receipt of copy of this order and the petitioner is at liberty to urge all these grounds before trial court and the trial court shall consider them without being influenced by dismissal of this criminal petition.
6. As a sequel, miscellaneous petition if any, pending shall
stand closed.
