This writ petition is filed for a Mandamus to set aside letter dated 09.11.2012 issued by respondent No.2, whereunder he has declined to issue market value certificate on the ground that the property in question is classified as “Tholla Parishrama” and, thereby, fed to the computer as Government land prohibited for registration.

At the hearing, it is not disputed that in judgment dated 31.12.2012 in W.P.No.30526 of 2012 and batch, this Court has considered in detail as to the manner in which Registering Officers have to treat the documents presented for registration and held that mere inclusion of the property in prohibitory register will not deter the Registering Officers from registering the property unless a statutory notification under Section 22-A (2) of the Registration Act, 1908 is issued covering the property in respect of which the sale deed is presented for registration. Further directions were also issued as to the manner in which the Registering Officer has to deal with the documents pertaining to the properties included in the prohibitory register.

In the light of the above judgment, respondent No.2 is directed to issue market value certificate, receive the document that may be presented by the petitioner and process the same in the light of the directions contained in the abovementioned judgment.

Subject to the above directions, the Writ Petition is allowed. As a sequel, WPMP.No.45300 of 2012, filed for interim relief, is disposed of as
