ORDER:
This writ petition is filed for the following substantive relief:
“…to issue an order, direction or writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondent in not furnishing details such as Account statement, transaction particulars of the gold delivery register in various gold loan accounts, Account statements of premature credit of fixed deposit proceeds to the gold loan and other accounts bearing No.02070021000143251, and A/c.No.0207009300094727 with the respondent bank, in spite of several letters and notices, as highly arbitrary, illegal, capricious and opposed to principles of natural justice and also contrary to the theory of legitimate expectation and consequently direct the respondent to forthwith furnish the particulars of the transactions rendered in the above accounts including D.Cs, account statement, transfer endorsed.”
On 28.01.2013, the learned counsel for the petitioner requested for an adjournment for getting instructions on the exchange of correspondence after filing of the writ petition. Today, when the case is taken up, neither the learned counsel for the petitioner is present nor
any purported exchange of correspondence between the parties has been filed. Hence, it is reasonable to presume that the petitioner is not interested in pursuing its cause in the writ petition.
The writ petition is accordingly dismissed for non-prosecution. As a sequel to dismissal of the writ petition, W.P.M.P.No.38731 of 2012 shall stand disposed of as infructuous.
