The Court made the following: ORDER:

The Writ Petition is filed for a Mandamus to set aside the order in proceedings No.C/784/2012, dated 30.09.2013, of the Deputy Collector and Tahsildar, Hayathnagar Mandal, Ranga Reddy District.

At the hearing, Sri S.Satyam Reddy, the learned senior counsel appearing for the petitioner, has not disputed that against the order impugned in this Writ Petition, his client has a remedy of a statutory appeal under Section 10 of the Andhra Pradesh Land Encroachment Act,1905, before respondent No.2.

In view of existence of an effective alternative remedy, this Court is not inclined to entertain the Writ Petition for adjudication on merits. However, having regard to the apprehension of the petitioner that the impugned order of eviction may be given effect to even before the petitioner files an appeal and secures an interim order, respondent No.1, i.e., the Deputy Collector and Tahsildar, Hayathnagar Mandal, Ranga Reddy District, is restrained from taking coercive steps in respect of the property in question for a period of one month from today to enable the petitioner to file an appeal and seek appropriate interim order therein.

Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, W.P.M.P.No.36617 of 2013 is disposed of as infructuous.
