Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to release the petitioner on bail pending investigation, enquiry and trial into Crime No. 132 of 2013 of I Town Police Station, Proddatur, Y.S.R.Kadapa District, in the interest of justice.

The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Akurathi Ramakrishna, Advocate for the Petitioners and of Addl. Public Prosecutor for the Respondent, the Court made the following.

ORDER:

“This criminal petition is filed by the petitioner-Accused No.1 under Sections 437 and 439 of the Criminal Procedure Code seeking bail in Crime No.132 of 2013 of I Town Police Station, Proddatur, YSR Kadapa registered for the offence punishable under Sections 147, 148, 324, 365, 386 read with 149 of IPC.

2. Heard the learned counsel appearing for the petitioner- Accused No.1 and the learned Additional Public Prosecutor representing the respondent-state.

3. The allegation against the petitioner and other accused

is that they committed the alleged offence for ransom. There are some other cases of similar nature pending against the petitioner. However, in the remaining cases, the petitioner and the other accused were granted bail. In all the cases, charge sheets were filed and in the course of investigation, no identification parade was conducted and no property was recovered. There is inordinate delay in lodging the complaint. Considering all aspects of the matter, more particularly, he as well as the co-accused were granted bail in the remaining cases, I am inclined to grant bail to the petitioner in this case.

In the result, the Criminal Petition is allowed and the petitioner – Accused No.1 is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of the I Additional Judicial Magistrate of First Class, Proddatur. It is further directed that the petitioner shall report before the Station House Officer, Proddatur I Town Police Station, Proddatur, YSR Kadapa District on every Wednesday between 10.00 a.m. and 2.00 p.m. until further orders.”
