Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to enlarge the petitioner-accused on bail who arrested in Crime No.32 of 2013 of Koyyalagudem P.S., West Godavari District.

The Court made the following Order:

“This criminal petition is filed by the petitioner-Accused No.6 under Sections 437 and 439 of the Criminal Procedure Code seeking bail in Crime No.32 of 2013 of Koyyalagudem Police Station, West Godavari District registered for the offence punishable under Sections 417, 493, 376, 420, 506 and 109 of Indian Penal Code.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor representing the respondent-state.

3. It is submitted that A1 who is the prime accused in this case was arrested and released on bail. The petitioner herein is relative of A1 and the allegation against him is that he along with the remaining accused went to the de facto complainant and threatened him.

4. Therefore, this Court is of the view that the petitioner can be granted bail.

5. The petitioner shall be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand

only) with two sureties for the like sum each to the satisfaction of the Judicial Magistrate of First Class, Jangareddigudem, West Godavari District.

6. The Criminal Petition is accordingly allowed.”
