3. The brief facts are that the joint family of the husband of the de facto complainant owns a rice mill called as Gangayama Rice Mill, situated in Komaripalem village, Biccavole Mandal. The husband of the de facto complainant borrowed some loan from the State Bank of India, Commercial Branch, Kakinada and he could not repay the said loan. Thereafter, the State Bank of India having recourse to the Securitization Act to recover the debt auctioned the rice mill and the de facto complainant became the highest bidder in the auction and ultimately it was sold to the de facto complainant. In the meanwhile, the minor children of the first petitioner filed O.S.No.83 of 2005 on the file of First Additional District Judge, Rajahmundry through the first petitioner claiming their shares in the rice mill and in the said suit, preliminary decree was passed. Against the said preliminary decree, the State Bank of India filed an appeal in A.S.No.204 of 2009 before this Court and the Division Bench of this Court in A.S.M.P.No.1520 of 2009 issued a direction to the respondents therein not to dispossess the minor children of the first petitioner. In the present case, the de facto complainant is one Suresh. He is said to be the coolly engaged by K. Rama Mohana Rao, who is the de facto complainant in Crl.P.No.10379 of 2013. It is alleged that the de facto complainant in this case belongs to Madiga community, which is a scheduled caste and on 08.09.2013 while he was working in the premises of the rice mill along with other coolies, all the petitioners attacked him and abused him in his caste
