JUDGMENT:-
On two previous occasions i.e. on 23.01.2013 and 30.01.2013, when the matter was called, none appeared for the appellant nor was made any representation on his behalf, as such the matter was directed to be posted to this day under the caption “for dismissal”. Even today, when the matter is taken up for hearing, the learned counsel for the appellant is not present and there is no representation on his behalf. Hence, it appears that the appellant is not interested in prosecuting the matter any further.
In the circumstances, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No order as to costs.
