I have heard Sri R. Radhakrishna Reddy, learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. The petitioner, which is running a medical college and hospital, is under the occupation of an extent of Ac.1.20 guntas in Sy.Nos.93 and 94 of Pakabanda, Khammam Urban Mandal. The petitioner is stated to have made an application to the Government for alienation of the said land for market value for convenient enjoyment of the property, which is stated to be situated in the midst of the land belonging to it. It is stated that the petitioner’s application was forwarded to the District Collector, Khammam for submitting a report and that the said application is stated to be pending before the Principal Secretary and Commissioner, Land Administration, Government of A.P. While so, respondent No.2 has issued notice dated 06.09.2010 under Section 7 of the A.P. Land Encroachment Act, 1905 (for short, “the Act”). The petitioner submitted its reply dated 21.09.2010 wherein the above facts have been mentioned. However, by order dated 02.12.2010, respondent No.2 has passed a final order under Section 7 of the Act ordering eviction of the petitioner. Feeling aggrieved by the said order, the petitioner filed an appeal under Section 10 of the Act.
