ORDER:
The petitioner, who is a fair price shop dealer and whose authorisation has been suspended by order dated 18.11.2010 of respondent No.2 filed this writ petition for a mandamus to set aside the said order.
A perusal of the averments made in support of the writ petition shows that subsequent to the passing of suspension order, the petitioner has submitted a representation on 26.11.2010 to respondent No.2 for restoration of his authorisation. The grievance of the petitioner is that respondent No.2 has not proceeded further to complete the enquiry and pass an appropriate order.
Inasmuch as, proceedings were initiated very recently, respondent No.2 requires some reasonable time for completing the enquiry and passing a final order. As the petitioner’s authorisation was suspended on certain allegations, it is not appropriate for this Court to interfere with such order of suspension at this stage.
Keeping in view the grievance of the petitioner regarding pendency of enquiry, respondent No.2 is directed to complete the enquiry and pass a final order within a period of two months from the date of receipt of a copy of this order, after giving the petitioner an opportunity of being heard.
Subject to the above directions, the writ petition is disposed of.
As a sequel to dismissal of the main petition, W.P.M.P. No.38440 of 2010 filed by the petitioner for interim relief is disposed of as infructuous.
