The petitioner claims to be the owner of vehicle bearing registration No. AP 03/T 8620, which was granted pucca stage carriage permit, valid upto 24.01.2008. Before expiry of the validity period, the petitioner states that he made application dated 09.01.2008 in prescribed form requesting the respondent to renew the stage carriage permit, followed by another representation dated 10.03.2008, but no action thereon had been taken. Hence, he filed the present writ petition.

The learned Assistant Government Pleader for Transport took notice of the writ petition on behalf of the respondent, and on instructions he submitted that the petitioner vide proceedings dated 10.01.2008 of the respondent, was advised to produce valid records in r/o S.C. No. TN57 1564 i.e. valid F.C. L.C., and tax payment for the current quarter within 30 days from the date of receipt of the said proceedings, and he was also requested to produce the NOC. However, the petitioner has not produced the said record.

The learned counsel for the petitioner submitted that the petitioner was not communicated any such proceeding. However, the copy of the proceedings dated 10.01.2008 of the respondent, produced by the learned Assistant Government Pleader for Transport shows that it was posted to the address of the petitioner by RPAD.

Be that as it may, both the learned counsel for the petitioner and the learned Assistant Government Pleader for Transport agreed for disposal of the writ petition with the following directions:

The respondent is directed to communicate a copy of the proceedings dated 10.01.2008 to the petitioner, and on such communication, the petitioner shall within 15 days from the date of its receipt, shall produce the records as sought for by the respondent, and thereupon the respondent shall consider the request of the

petitioner for renewal of his permit and pass appropriate orders thereon in accordance with law.

Accordingly, the writ petition is disposed of. No costs.
