Petition under Article 226 of the constitution of India praying that in the circumstances stated in the affidavit filed herein the High Court may be pleased to issue an order or direction more particularly one in the nature of writ of mandamus directing the respondent consider the representation dated 2.2.2008 and legal notice 1.3.2008 regarding the entire file pertaining to issuance occupancy Rights Certificate dated 9.1.1998 in ORC.No.J/5378/1997.

This writ petition is filed seeking a Writ of Mandamus directing the respondent to consider the representation of the petitioner, dated 02.02.2008, and the legal notice dated 01.03.2008, issued by him seeking to enquire the matter regarding issuance of Occupancy Rights Certificate dated 09.01.1998 in O.R.C.No.J/5378/1997, issued in favour of one Medimela Yadaiah.

Petitioner is stated to be the absolute owner and possessor of the land admeasuring Ac.1.00 in Sy.No.155/AA situated at Doolapally village of Qutbullapur Mandal in Ranga Reddy District, having purchased the same under a registered sale deed dated 17.07.2007. Petitioner states that one Medimella Yadaiah, who was the owner of the land in Sy.No.154 of Doolapally village, in collusion with the revenue officials, obtained Occupancy Rights Certificate in his name showing that he is the absolute owner of the land in question, and taking advantage of the said certificate, the vendee of Medimella Yadaiah, tried to grab the land in question from the petitioner. The case of the petitioner is that he made a representation dated 02.02.2008 followed by a legal notice dated 01.03.2008, brining all the facts to the notice of the respondent and requesting him to seize the entire file regarding the said Occupancy Rights Certificate and also to make an enquiry into the matter, but in vain. Hence, he filed this writ petition, seeking a direction to the respondent to consider his representation dated 02.02.2008 and the legal notice dated 01.03.2008.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue and both of them agreed

for disposal of the writ petition with the following direction.

The respondent-District Collector, Ranga Reddy District is directed to consider the representation of the petitioner dated 02.02.2008 and pass appropriate orders thereon in accordance with law, expeditiously, preferably within a period of three months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.
