ORAL ORDER:
On 19-2-2007 the specified stock of Red gram, Red gram Dal and Bengal gram belonging to the petitioner were seized under a panchanama recorded, for violation of the Andhra Pradesh Scheduled Commodities Dealers (Licensing and Distribution) Order, 1982 as in force by the orders of the Government vide G.O.Ms.No.64 Consumer Affairs, Food and Civil Supplies (CS.I) Department, dated 23-9-2006. On 26-2-2007 the petitioner made a representation to the 1st respondent for release of the stocks and for the reasons stated in the representation. The petitioner apprehends that the stocks of the seized commodities would be sold even before his representation is considered and disposed of by the 1st respondent. The 1st respondent has not yet communicated to the petitioner any decision on his representation.
In the circumstances, the writ petition is disposed of at the stage of admission, after hearing the learned Government Pleader for Civil Supplies also, directing the 1st respondent not to dispose of by sale including by public auction the commodities of the petitioner seized on 19-2-2007, before disposing of his representation dated 26-2-2007. The 1st respondent shall
communicate the decision on the petitioner’s representation by registered post with acknowledgment due. There shall be no order
as to costs.
