The petitioner is aggrieved that the second respondent has not conducted de novo inquiry with regard to the grant of authorization for running a Fair Price Shop in Vangamarthi village, Shaligouram mandal, Nalgonda district, despite a direction of the first respondent in the order dated 18-12-2006 to conduct a fresh enquiry and take appropriate decision, within four weeks positively.

The third respondent preferred an appeal to the first respondent against the order of the second respondent granting authorization to the petitioner to run the Fair Price Shop in question. The first respondent recorded certain observations in the appellate order wherefor the first

respondent recorded the opinion that the matter requires a de novo consideration and accordingly directed the second respondent to take a decision afresh. The petitioner is aggrieved that she is denied the opportunity to pursue the business/occupation as a Fair Price Shop Dealer on account of the delay by the second respondent in conducting the de novo enquiry within the time stipulated by the first respondent in the appellate order.

In the circumstances above, after hearing the learned Government Pleader for Civil Supplies, the writ petition is disposed of directing the second respondent to expeditiously and in any event within a period of thirty (30) days from the date of receipt of a copy of this order, conduct de novo enquiry and take an appropriate decision in the matter. The decision shall be communicated to the petitioner and other interested parties within the aforesaid time. No costs.
