Apprehending his arrest in connection with FIR No.304/2025 registered at Police Station-Alwar Gate, District-Ajmer for the offences under Section 308(2) of BNS, 2023, the petitioner has preferred this bail application under Section 482 BNSS.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is further submitted that the allegation against the present petitioner pertains to an alleged life-threatening call made to the complainant over a mobile phone. In pursuance of the earlier order of this Hon’ble Court, the petitioner has joined and cooperated with the investigation. No custodial interrogation is

required. Hence, the bail application of the petitioner may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application.

Considering the fact that the petitioner has joined the investigation and is cooperating with the investigation of the case, no custodial interrogation is required but without commenting on the merits/demerits thereof, this Court deems it just and proper to allow the bail application of the petitioner.

Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner- Vijay Kumar Sharma S/o Shri Leeladhar Sharma , he shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

(iii) that the petitioner shall not leave India without prior permission of the court.
