Makhan S/O Mahendra Singh Vs State of Rajasthan

The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.1/2025 registered at Police Station Rudawal, District Bharatpur for offences under Sections 189(2), 126(2), 115(2), 125, 352 and 351(2) of BNS, 2023.

Heard learned counsel for the petitioner, learned Public Prosecutor and counsel for the complainant and perused the material available on record.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that there is an allegation of causing injuries to the injured persons Vishnu and Jagdish on the eye and nose, respectively but the injury caused to Vishnu was specifically attributed to Atar Singh, and as a result of that injury, Vishnu has no visibility in that eye, as per the medical report and the injury attributed to petitioner is limited to injured Jagdish which is not dangerous to life. accused-Ashok, Ishwar Singh, Jagdish and Devendra have been enlarged on anticipatory bail by this Court on 29.10.2025, coaccused-Than Singh, Nepal @ Ganguli and Ompal have been enlarged on anticipatory bail by Coordinate Bench of this Court on 25.07.2025 and co-accused-Dharamveer has been enlarged on bail by Coordinate Bench of this Court on 01.09.2025. Petitioner is behind the bars since his date of arrest. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, accordingly, the bail application deserves to be allowed.

Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Makhan S/o Mahendra Singh , be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
