This bail application has been filed by the petitioner under Section 483 of BNSS in connection with FIR No.357/2025 registered at Police Station Shahpura (Jaipur Rural), District Jaipur Rural for offences under Section 189(2), 140(1), 309(4), 115(2), 127(2), 111(2)(b) of BNS and Section 3 & 25(6) of the Arms Act. 2. Mr. Manish Kr. Swami, the brother of the accused petitioner puts appearance on behalf of the accused petitioner and submits that the accused petitioner has been falsely implicated in this case. He also submits that co-accused Deepak and Kuldeep who were also arrested on the spot alongwith the present accused petitioner have already been enlarged on bail by the Additional Sessions Judge No. 1 Shahpura, District Jaipur vide order dated 16.01.2026 in bail application No. 17/2026. It has also been

submitted that other co-accused persons have also been enlarged on bail by this Court.

Learned Public Prosecutor vehemently opposed the bail application.

The allegation against the accused petitioner is that he alongwith two other co-accused kidnapped three persons and they were caught and a pistol was recovered from the possession of the accused petitioner for which he was not having license.

Taking into consideration the overall facts and circumstances of the case and the allegation against the accused petitioner and more particularly the fact that other co-accused persons have already been enlarged on bail, this Court, without expressing any opinion on merits/demerits of the case, deems just and proper to enlarge the accused petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes personal bonds in the sum of Rs. 1,00,000/- (Rupees One Lac Only) each, together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only)(each) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
