The instant bail application has been filed under Section 483 of the BNSS, 2023 on behalf of accused-petitioners in connection with FIR No. 431/2024 registered at Police Station Kolari, District Dholpur for the offences under Sections 189(2), 115(2), 126(2), 125, 109(1), 329(4) and 352 of BNS, 2023.

Learned counsel for the accused-petitioners submits that the present accused-petitioners have been falsely implicated in this case. He also submits that because of dispute over the boundary of agricultural field, the complainant party has lodged the present case implicating all the family members of the accused party.

Learned counsel for the accused-petitioners further submits that the injuries said to have been sustained by the complainant

party in the alleged incident are simple in nature and the accusedpetitioners are in custody since 18.12.2025.

Learned Public Prosecutor and learned counsel for the complainant opposed the bail application.

Having regard to the submissions made by the learned counsel for the accused-petitioners and more particularly the fact that all the injuries sustained by the complainant party are simple in nature and the also the fact that the accused-petitioners are in custody since 18.12.2025, this Court without expressing any opinion on the merits and demerits of the case deems just and proper to enlarge the accused-petitioners on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners named above shall be enlarged on bail provided that they furnish a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- (each) to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
