The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 0270/2024 registered at Police Station Phagi District Dudu for the offence(s) under Sections 331(4), 305(a) of BNS, 2023.

Learned counsel for the accused–applicant has submitted that the applicant is in custody ever since 27.01.2025 and the matter at hand is triable by the Magistrate. It is further submitted that the allegations leveled against the applicant are petty in nature.

Per contra , learned Public Prosecutor has vehemently opposed the instant bail application and submitted that the release of the applicant would pose a serious threat to society, as the

applicant is actively involved in offences of similar nature in the areas of Kuchaman, Jobner, Ringas, Parbatsar, Bagru, Nahargarh Road, Sambhar Lake, Nagaur, among others. It is further submitted that there are as many as 29 criminal antecedents registered against the applicant. It is further submitted that the bail ought not to be granted to the applicant at this stage, and if the applicant shall be enlarged on bail, the same shall be subject to the imposition of stringent conditions upon the applicant, especially in view of the applicant’s own statement expressing readiness to reside and work away from the municipal limits for a period of six months.

Having heard the arguments advanced by learned counsel for the parties, considering the fact that the matter at hand is triable by the Magistrate; that the applicant is in custody ever since 27.01.2025; that the allegations leveled against the applicant are petty in nature and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the instant bail application of the accused-applicant and enlarge him on bail.

Considering the voluntarily reformative approach of the applicants, ignoring the criminal antecedents and keeping in mind the sacrosanct objective of Indian criminal reformative system, this Court is inclined to enlarge the accused-applicants on bail with following conditions:

5.1 That on every 5^th of successive month, applicant will mark attendance before the jurisdictional police station, as and till directed.

5.2 That applicant will go for his employment/work and live away from his place of residence/municipal limits for a period of six months, as voluntarily submitted by the applicant.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Rudmal @ Kajod S/o Late Ramuram shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
