The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 20/2024 registered at Police Station Special Police Station (SOG), District - ATS & SOG for the offence(s) under Sections 419, 420, 467, 468, 471, 120-B of IPC and Section 3, 4 & 6 of the Rajasthan Public Examination (use of unfair means) Act, 1992.

Learned counsel for the accused-applicant has submitted that the bail application of the alleged dummy candidate in one of the connected matters has already been rejected. It is further submitted that the role attributed to the applicant in the matter at hand is merely that of an accomplice or supporter. Learned counsel further contends that in identical matters pertaining to the period prior to the enactment of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act,

2022, wherein the said offence was triable by the Magistrate and the maximum prescribed sentence for the same was three years, the bail was granted to similarly placed co-accused.

Further, learned counsel of the applicant has relied upon an order dated 18.08.2025 passed in the case of Deepak Kumar Meena Vs. State of Rajasthan in S.B. Criminal Bail Application No. 15968/2024 , wherein a Sub-Inspector, assigned a similar role, has been enlarged on bail by the Coordinate Bench of this Court. Learned counsel of the applicant, therefore, prays that the principle of parity be applied in the instant matter, taking into consideration the applicant’s antecedents and the other relevant factors.

Per contra, learned Public Prosecutor and the learned Investigating Officer have opposed the instant bail application. However, they are not able to refute the contentions of learned counsel for the accused-applicant vis-a-vis the reliance placed upon the aforestated ratio. 5. Considering the arguments advanced by the counsel for the parties, that the applicant is a young person, aged about 27 years; that the matter at hand is triable by the Magistrate; that to maintain the parity with order dated 18.08.2025 passed by the Co-ordinate Bench wherein applicant with a similar role has been enlarged on bail and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Deepak Kumar
