The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 52/2024 registered at Police Station Aravali Vihar, District Alwar for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC.

Learned counsel for the accused-applicant has submitted that applicant is a sole bread earner of the family, aged about 25 years and is in custody ever since 18.09.2025. It is further submitted that the wife of applicant is on family way and carrying an embryo of 34 weeks. It is also submitted that the service of the applicant has already been terminated on account of fake marksheet and the matter at hand is triable by the Magistrate.

Per contra , learned Public Prosecutor has vehemently opposed the instant bail application.

Having heard the arguments advanced by the learned counsel of the parties and considering the fact that the applicant is in custody from 18.09.2025; that the wife of applicant is on family way and carrying an embryo of 34 weeks; that applicant is sole bread earner, aged about 25 years; that the matter at hand is triable by the Magistrate and considering the exceptional circumstances as referred above but without commenting upon merits/demerits of the case, this Court is inclined to enlarge the accused-applicant on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Hitesh Kumar S/o Shri Harnarayan shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
