These bail applications have been filed under Section 483 BNSS on behalf of accused-applicants. The accused-applicants were arrested in connection with FIR No.302/2025 registered at Police Station Sadar, Dholpur District Dholpur for the offence(s) under Sections 303(2) of BNS, later on converted under Sections 303(2), 112(2) of BNS.

Learned counsel for the applicant has submitted that the offences are triable by First Class Magistrate. It is submitted that the applicants are in custody ever since 07.10.2025 and the matter pertains to theft of TV, colour printer etc.

Per contra , Learned Public Prosecutor has opposed the bail application.

Heard and considered.

Considering the arguments advanced by the counsel for the parties, the fact that the offences are triable by First Class Magistrate; that the trial will take a long time and looking to the overall facts and circumstances of the case and material on record, this court is inclined to allow the bail application of the accused-applicants and enlarge them on bail subject to condition that accused-applicants shall mark their presence before the SHO/Investigating Authority, at the Police Station concerned, on every 5^th of successive two months.

Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that accused-applicants Michael S/o Yogendra, Kuldeep S/o Bablesh and Avinash S/o Sukharam shall be enlarged on bail provided they furnish a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
