The instant appeal has been filed under Section 14A(2) SC/ST (Prevention Of Atrocities) Act on behalf of the appellants, who are in custody in connection with FIR No. 111/2025 Police Station Bhimganj Mandi District Kota City for the offences under Sections 115(2), 126(2), 3(5) of BNS and 3(2)(va) of the SC/ST (Prevention Of Atrocities) Act.

It is submitted by learned counsel for the appellants that cross FIRs are lodged. It is further submitted that against the appellants, allegations are leveled under Section 110 BNS and

against the complainant same are under Section 109 BNS and both sides have sustained injuries. It is also submitted that fight occurred in a fit of rage and a person related to the complainant has already been enlarged on bail.

Per contra , learned Public Prosecutor and counsel for the complainant have opposed the appeal. 4. Considering the arguments advanced by learned counsel for the parties, considering that cross FIRs were lodged; that a person related to complainant has already been enlarged on bail and looking to the over

all facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicants and enlarge them on bail.

Consequently, the instant appeal is allowed. The impugned order dated 17.09.2025 passed by the Special Judge, SC/ST (Prevention Of Atrocities) Cases, Kota is set aside. It is ordered that the accused-appellants 1. Ramgopal Son Of Bhairulal and 2. Aakash Kumar @ Ashu Son Of Ramgopal , arrested in connection with aforesaid FIR, shall be released on bail, if not wanted in any other case, provided each of them furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
