The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 77/2025 registered at Police Station Banipark, District Jaipur (West) for the offence(s) under Section 303(2) of BNS, 2023.

Learned counsel for the accused-applicant has submitted that there are strong criminal antecedents, howsoever, applicant is in custody from a long period of time, charge-sheet has been filed. It is voluntarily submitted that he wants to adopt the reformative approach and keep himself away from Jaipur/municipal limits other than the days when he is required in the Court and the police station.

Learned Public Prosecutor has vehemently opposed the instant bail application.

Heard and considered.

Considering the voluntarily reformative approach of the applicant, ignoring the 12 criminal antecedents and keeping in mind the sacrosanct objective of Indian criminal reformative system, this Court is inclined to enlarge the accused-applicant on bail with following conditions:

5.1 That on every 5^th of successive month, applicant will mark attendance before the jurisdictional police station, as and till directed.

5.2 That applicant will go for his employment/work and live away from his place of residence (i.e. away from municipal limits Jaipur) for a period of six months, as voluntarily submitted by the applicant, because applicant is habitual offender in the vicinity of Gandhi Nagar, Shastri Nagar and other areas of Jaipur.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Kishan Verma S/o Shri Rameshwar Lal shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.

Respondent-State will be at liberty to move bail cancellation application, if the terms and conditions are not complied with.
