The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.354/2025 registered at Police Station-Nadbai, District-Bharatpur for the offences under Sections 189(2), 115(2), 126(2), 333 and 109(1) of BNS.

Since all these bail applications have arisen from common order, hence, they are being decided by this single order.

Heard learned counsel for the petitioners, learned Public Prosecutor and counsel for the complainant and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submitted that though there is an allegation of use of a firearm but none of the injuries are dangerous to life and there is no medical opinion to that effect. It is submitted that the allegation of causing firearm injury to Sarman pertains to a non-vital part of the body, and the injury to Pista was on the left leg, which is also not a vital part. It is further submitted that though two criminal cases are pending against the accused-petitioner Vishal, one case is pending against the accused-petitioner Bhola, and three cases are pending against the accused-petitioner Boby, there are no cases pending against the accused-petitioners Jaiprakash and Sunni. No custodial interrogation of the petitioners is required. It is also submitted that the petitioners Sanni, Sourabh, and Boby have been in custody since 22.08.2025; petitioner Jaiprakash @ Bittu has been in custody since 23.08.2025; and petitioners Vishal and Bhola have been in custody since 03.09.2025. The trial of the cases may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail applications of the petitioners may be allowed.

Learned Public Prosecutor and counsel for complainant have vehemently opposed the bail applications.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on

the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the petitioners -Jaiprakash @ Bittu S/o Babulal, Sanni S/o Nirbhay Singh, Vishal @ Nepali S/o Munesh, Bhola @ Leelo S/o Banay Singh, Sourabh S/o Dharamveer and Boby S/o Rakesh @ Prathvi shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
