This second bail application has been filed by the petitioner under Section 483 of the B.N.S.S. arising out of F.I.R. No.204/2024, registered with the Police Station Malpura Gate, District Jaipur City (East) for offences under Sections 3/25 (1)(A) (B) of the Arms Act, 1959 (Amended 2019).

First bail application bearing S.B. Criminal Misc. Bail Application No.6192/2024 filed by the petitioner was dismissed by this Court as withdrawn vide order dated 24.09.2024.

Considered the submissions made at bar and also perused the challan papers as well as the statements of the prosecution witnesses examined so far.

The accused-petitioner has been chargesheeted for offence

under Section 3/25 (1)(A)(B) of the Arms Act and he is in custody since 26.04.2024.

Taking into consideration the nature of allegations against the petitioner so also the fact that he is in incarceration for last more than eight months and the fact that the offences as alleged against the petitioner are triable by the Magistrate, this Court without expressing any opinion on merits and demerits of the case, deems just and proper to enlarge the petitioner on bail. 7. Accordingly, this second bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before the trial Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
