This bail application has been filed under Section 483 of B.N.S.S, 2023 by the accused-petitioner in connection with FIR No. 248/2024 registered at Police Station Govindgarh (Alwar), District- Alwar for offences under Section 309(6) of B.N.S., 2023. 2. Learned counsel for the petitioner submits that the allegation against the accused-petitioner is of snatching Rs. 5000/- from the complainant. Counsel also submits that the police after completion investigation has submitted charge-sheet against the accusedpetitioner and he is in custody since 29.07.2024. As per the averments made in the First Information Report, the accusedpersons are unknown and after arresting of the accused-petitioner no identification parade was conducted so as to get identified the accused-petitioner by the complainant whether he is involved in the matter or not. In the absence of the identification parade, the

possibility of false implication cannot be ruled out. It is also there on record that co-accused Naresh has already been enlarged on bail and the case of the present accused-petitioner is in no manner distinguishable from the case of co-accused Naresh.

Learned Public Prosecutor vehemently opposed the bail application. 4. Considered the submissions made at Bar and also perused the Challan papers. 5. Taking into consideration, the totality of the facts and circumstances of the case, so also the allegations against the accused-petitioner which are triable by Magistrate, the police has submitted the charge-sheet and co-accused has already been released on bail, this court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so.
