The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No.180/2025 registered at Police Station Dug, District Jhalawar for the offence(s) under Sections 74, 333, 351(2) of BNS.

Learned counsel for the applicant has submitted that the applicant is a young boy, aged 19 years and the victim in question is also a major. It is submitted that the applicant and the victim are in a close relationship with each other. It is submitted that the initial FIR was lodged on 24.07.2025, wherein the allegations were of injury upon the neck, causing disturbance to privacy, however, after seven days, on family pressure, allegation of rape was levelled in the FIR, however, the medical report is not suggestive

of the same. It is submitted that even the medical report is suggestive only of neck injury. It is further submitted that the applicant has been in custody ever since 10.08.2025 and the charge-sheet has been filed. It is also submitted that the applicant has no criminal antecedents.

Per contra , learned Public Prosecutor has opposed the bail application. It is submitted that the statements are testimony to the happening of the incidence.

Considering the arguments advanced by the counsel for the parties, the fact that applicant is a young boy, aged 19 years and the complainant is also a major; that the initial FIR is not alleging the offence of rape; the first medical report is suggestive of only neck injury; that the charge-sheet has been filed and trial will take a long time and looking to the overall facts and circumstances of the case and material on record, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Devendra Pradhan S/o Vishal shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
