The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicants. The accused-applicant was arrested in connection with FIR No. 49/2024 registered at Police Station Gehnoli Mod, District Bharatpur for the offence(s) under Sections 420, 406, 120-B of IPC.

Learned counsel for the applicants has submitted that the applicants are sole bread earners of their family and that the applicants are being falsely implicated in the matter. It is submitted that the co-accused has been enlarged on bail under similar nature of offence by the Co-ordinate Bench on 19.08.2025. It is also submitted that the applicants are ready to abide by the condition, if imposed by the Court.

Per contra , learned Public Prosecutor and counsel for the complainant have opposed the bail application. It is submitted that the applicants have criminal antecedents of a similar nature and that they have been charged with using bank accounts and committing the crime along with co-accused Ramphal, whose bail application has been rejected by the Co-ordinate Bench of this Court. It is also submitted that unemployed poor persons were trapped and fraud was committed and that the complainant is one of the victims in the same, who has been cheated of Rs.10 lakhs.

Heard and considered.

Considering the arguments advanced by the counsel for the parties, the fact that charge-sheet has been filed and co-accused has been granted bail, that the trial will take a long time and looking to the overall facts and circumstances of the case and material on record, this court is inclined to allow the bail application of the accused-applicants and enlarge them on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicants Lokesh Rawat S/o Saimla and Yogesh Kumar S/o Saimla shall be enlarged on bail provided they furnish a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each along with bank guarantee of Rs. 2,50,000/- (Rupees Two Lac and Fifty Thousand) each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
