This bail application has been filed by the petitioners under Section 483 of the B.N.S.S. arising out of F.I.R. No.0154/2024, registered with the Police Station Madanganj, District Ajmer for offences under Sections 147, 323, 504, 143, 307 & 452 of IPC.

Learned counsel for the petitioners submits that the petitioner Nos.2 & 3 namely Sunil Banjara and Babu Banjara have not been named in the FIR and there is no allegation against petitioner No.1- Umrao Singh @ Ambu Singh of causing any grievous or dangerous to life injuries to the complainant party. Counsel further submits that the petitioners are in custody since

25.07.2024 and the Police after conclusion of the investigation has submitted charge-sheet in the matter and trial of the case will take its own time, therefore, the petitioners may be released on bail.

Learned Public Prosecutor appearing for the State opposed the bail application and submits that five persons were injured in the alleged incident and they have sustained the injuries which have been opined to be grievous and dangerous to life in nature.

Considered the submissions made by learned counsel for the petitioners as well as learned Public Prosecutor and also perused the challan papers.

Having considered the facts & circumstances under which the alleged incident has taken place and the fact that petitioners have inflicted injuries to the complainant party and furthermore the likelihood of influencing or tampering with the witnesses by the accused party, this Court at this stage is not inclined to enlarge the petitioners on bail.

Accordingly, this bail application filed under Section 483 of the B.N.S.S. is dismissed.

However, the petitioners would be at liberty to to file fresh bail applications after examination of the injured witnesses.
