This second bail application has been filed by the accused petitioner under Section 483 of the B.N.S.S. in connection with FIR No.121/2024 registered at Police Station Modak, District Kota Rural for offences under Sections 5, 6 & 8 the Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act, 1995 and under Section 11 of the Prevention of Cruelty to Animals Act, 1960.

The first bail application ( S.B. Criminal Misc. Bail Application No.8656/2024 ) filed on behalf of the petitioner was dismissed as withdrawn by this Court vide order dated 16.07.2024 with liberty to file fresh bail application after filing of charge-sheet.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the Police after completion of investigation has submitted charge-sheet in the matter. Counsel further submits that no other criminal case is

pending against the petitioner. Counsel further submits that the trial of the case will take its own time, therefore, the petitioner may be released on bail.

Learned Public Prosecutor vehemently opposed this second bail application.

Having considered the submissions made by learned counsel for the petitioner so also the allegations levelled against the petitioner and further the fact that the Police after completion of the investigation has submitted charge-sheet in the matter and also the fact that no other criminal case is pending against the petitioner, this Court without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioners on bail.

Accordingly, this second bail application is allowed and it is directed that accused-petitioners shall be released on bail provided that they furnish a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only)(each), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) each to the satisfaction of the Trial Court with the stipulation that they shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
