This second bail application has been filed by the accused petitioner u/S 483 BNSS in connection with FIR No. 70/21 registered at Police Station Wildlife Flying Squad, Zoo, Jaipur for offence under Section 2(16), 9, 39, 42, 44, 49A, 49B, 50/51 of Wildlife Protection Act, 1972.

The first bail application No. 8244/2024 was dismissed as withdrawn vide order dated 26.07.2024 with liberty to file fresh bail application after completion of investigation.

Learned counsel for the accused petitioner submits that after completion of investigation, the police has submitted charge-sheet in the matter. He further submits that the allegation against the accused-petitioner is of possession and selling of Ivory Bangles and there is a recovery of 20 Bangles which is said to have been sold by the accused-petitioner at the rate of Rs.400/- per Bangle.

He further submits that the accused petitioner is in custody since 27.06.2024 and the trial will take its own time, therefore the accused petitioner may be released on bail.

Learned Public Prosecutor vehemently opposed the bail application.

Having considered the submissions made by learned counsel for the accused petitioner and so also the allegations against the accused petitioner and further the fact that the police has submitted charge-sheet in the matter, this Court, without expressing any opinion on merits or demerits of this case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this second bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/(Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
