Petitioners have filed this bail application under Section 483 B.N.S.S. arising out of F.I.R. No.87/2024 registered with the Police Station Mehndipur Balaji, District Dausa for offence under Sections 457 & 380 of IPC.

Counsel for the petitioners submits that the accused-

petitioners have falsely been implicated in this case and they are in custody from the date of their arrest. Counsel further submits that the petitioners are no more required for any kind of interrogation or recovery and the trial of the case is likely to take considerable time to conclude, therefore, the petitioners may be enlarged on bail.

Learned Public Prosecutor has vehemently opposed the bail application and submits that there are other ten criminal cases pending against the present accused-petitioner No.1- Vijay @ Punda.

Considered the submissions made at bar so also perused the challan papers and the order of rejection of bail of the Court below.

As per the order passed by the Court below, ten other criminal cases are pending against the accused-petitioner No.1, however, all those cases were of particular period only.

Taking into consideration the allegations levelled against the petitioners so also the fact that the Police after completion of investigation, has submitted charge-sheet in the matter, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioners on bail.

This bail application is, accordingly, allowed and it is directed that accused-petitioners shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/(Rupees One Lac only) together with two sureties in the sum of

Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that they shall appear before that Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to
