The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner Gunesh Meena. The petitioner has been arrested in connection with FIR No.1116/2023 registered at Police Station Mansarowar, Jaipur City, South for the offence(s) under Sections 376(2) (N), 376-D of IPC.

Learned counsel for the petitioner submits that accusedpetitioner has been falsely implicated in the present case. He submits that accused-petitioner and prosecutrix were having affair and prosecutrix herself went with the accused-petitioner. He further submits that prosecutrix stayed with the accused-petitioner in the house No.75-A, Ganesh Vihar for 2-3 days. He also submits that thereafter, prosecutrix herself left the petitioner's place. The allegation of rape by the accused-petitioner is afterthought. The prosecutrix herself is an adult lady and petitioner is 18 years old

boy. The accused-petitioner is in custody from 29.11.2023 and the trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail.

Per contra, learned Public Prosecutor opposes the grant of bail application.

Heard and perused the case diary as well as the statement of prosecutrix recorded under Section 164 of the Cr.P.C. It is not desirable to comment anything on the merits of the case. Considering the fact that the petitioner is in custody from 29.11.2023 and investigation/trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Gunesh Meena S/o Hetram Meena in connection with FIR No.1116/2023 registered at Police Station Mansarowar, Jaipur City South shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
