The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioners Asloop & Vakil Ahmed. The petitioners have been arrested in connection with FIR No. 201/2023 registered at Police Station Kaithwada, District Bharatpur for the offences under Sections 143, 323, 341 & 354 of IPC.

Learned counsel for the petitioner submits that he does not want to press the criminal misc. bail application qua accusedpetitioner No.1 Asloop S/o Rehmat with liberty to file fresh bail application after recording the statement of injured-Shahid.

As regards accused petitioner No.2 Vakil Ahmed S/o Asloop, learned counsel for the petitioner submits that the injury sustained to injured Shahid is attributed to accused Asloop. There

is no specific allegation against the petitioner that he caused injuries to injured Arrifa, Sahista & Wahidan. The injuries caused to the above injured were found to be simple in nature. He also submits that on behalf of the petitioner a case was also registered against the complainant party and accused Asloop and other person also suffered injuries due to act of the complainant party. Trial of the case may take considerable time, therefore, the bail application of the petitioner Vakil Ahmed may be allowed.

Per contra, learned Public Prosecutor opposes the grant of bail application.

Considering the arguments advanced by the counsel for the parties, looking to the fact that injuries sustained to injured Shahid are attributed to Asloop, which were found to be dangerous to life, I deem it just and proper to enlarge the accused-petitioner No.2 Vakil Ahmed on bail.

Accordingly, the bail application qua accused petitioner No.1 Asloop is dismissed as not pressed with the liberty as prayed for.

However, the bail application of accused petitioner No.2 Vakil Ahmed under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Vakil Ahmed S/o Asloop in connection with FIR No. 201/2023 registered at Police Station Kaithwada, District Bharatpur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
