The instant bail application has been filed under Section 439 Cr.P.C. on behalf of accused-petitioner Laxman Kumawat. The petitioner has been arrested in connection with FIR No. 514/2023 registered at Police Station Harmada, District Jaipur (West) for the offences under Sections 420, 406, 467, 468 & 471 of IPC.

Learned counsel for the petitioner submits that the offences alleged to have been committed by the petitioner are triable by Magistrate. He further submits that the petitioner is in judicial custody since 19.12.2023 and the trial of the case may take considerable time. Therefore, the petitioner may be enlarged on bail.

Per contra, learned Public Prosecutor as well as learned counsel for the complainant vehemently oppose the grant of bail application. Learned counsel for the complainant submits that the petitioner, after obtaining Rs.12,49,000/- from the complainant with the pretext of lease deed to be executed in his favour and afterwards forged the patta. He further submits that the petitioner have no right to sell the alleged land. It is also alleged against the petitioner that the land is still in the possession of the khatedar. The khatedar never sold the property to the petitioner. Therefore, looking to the gravity of the offence the bail application of the petitioner may be dismissed.

Considering the arguments advanced by the counsel for the parties, looking to the fact that the case of the petitioner is triable by Magistrate, and petitioner is in judicial custody since 19.12.2023 and the trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Laxman Kumawat S/o Chhitarmal in connection with FIR No. 514/2023 registered at Police Station Harmada, District Jaipur (West) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
