Heard. Perused the material available on record.
The instant application for bail has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in custody in relation to F.I.R. No.61/2023 dated 24.02.2023, registered at Police Station Lohawat, District Jodhpur, for the offences under Sections 19/54 of the Rajasthan Excise Act, 1950.
Mr. Omprakash, brother of the petitioner present in person submits that the co-accused namely Madan has already been enlarged on bail by this Court vide order dated 17.03.2023 passed in SB Crl. Misc. Bail Application No.2697/2023. He also submits that case of the petitioner is at similar footings to that of the coaccused Madan.
Learned Public Prosecutor opposes the bail application, however agrees that the co-accused Madan has been enlarged on bail.

In view of the above and having regard to the entirety of facts and circumstances of the case as available on record and looking to the fact that the trial will consume time and without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the petitioner deserves indulgence of bail.
Consequently, the bail application is allowed. It is ordered that the accused-petitioner namely Vishnaram Jangu Alias Vihnu Jangu S/o Mohanram arrested in relation to the F.I.R. No.61/2023 dated 24.02.2023, registered at Police Station Lohawat, District Jodhpur, shall be released on bail; provided he furnishes a personal bond in the sum of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that court on all dates of hearing and as and when called upon to do so.
