Learned counsel for the petitioners submits that the petitioners had preferred an appeal challenging the revised chak

scheme situated at Chak No.18 DWD, however, till date, the appeal has not been decided by the competent authority i.e. respondent No.3-Superintendent Engineer. He further submits that the competent authority i.e. respondent No.3-the Superintendent Engineer, may be directed to decide the said appeal of the petitioners within a particular time frame.

In view of the submission made, it is hereby directed that the competent authority i.e. respondent No.3-the Superintendent Engineer shall decide the appeal preferred by the petitioners by way of passing a speaking order strictly in accordance with law within a period of ‘60 days’ from the date of receipt of certified copy of this order.

Till the decision of the appeal, the parties are directed to maintain status quo in respect to water course in question.

With the aforesaid direction, the instant writ petition stands disposed of. Stay application as well as all other pending applications, if any, also stand disposed of accordingly.
