Learned counsel Mr. CP Soni appearing on behalf of Mr. Aju V. Josh submits that under the instructions of his associate, he seeks permission to withdraw the writ petition as erroneously against the order dated 08.08.2023 (Annexure-6), the writ petition has been filed whereas the remedy available to the petitioner is of filing an appeal.
In view of the above, the writ petition is dismissed as withdrawn.
The petitioner would be at liberty to file an appeal, if so desired.
