This bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.62/2014 Registered at Police Station Vidhyadhar Nagar, Jaipur (North) for the offence(s) under Sections 341, 323 IPC (later on offence under Sections 341, 323, 324, 308, 451/34 IPC was found to have been made out).

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 04.01.2024. Learned counsel for the petitioner also submits that due to unavoidable reason, petitioner could not attend the trial court on 07.07.2023. So, his bail bonds were forfeited. Conclusion of trial may take long time. So, petitioner be enlarged on bail.

Learned Public Prosecutor has opposed the arguments advanced by learned counsel for the petitioner and submits that petitioner had misused the liberty of bail granted to him. So, bail bonds of the petitioner were forfeited on 22.09.2015. After that, the petitioner was arrested on 02.07.2018 and he was enlarged on bail by the trial court vide order dated 17.07.2018. After that, petitioner again did not appear before the trial court on 21.09.2021, his bail bonds were forfeited and arrest warrant was issued. Pursuant to which he was arrested on 06.05.2022 and this Court vide order dated 25.05.2022 enlarged the petitioner on bail. After that, the petitioner again did not appear before the Court on 07.07.2023. Resultantly, his bail bonds were forfeited and arrest warrant was issued. He further submits that the petitioner is a habitual absconder. So, the bail application filed by the petitioner be dismissed.

I have considered the arguments advanced by learned counsel for the petitioner as well as learned Public Prosecutor.

Petitioner had misused the bail granted to him and he did not appear before the Court thrice. So, looking to the fact that the petitioner is a habitual absconder, I do not consider it a fit case to enlarge the petitioner on bail.

Hence, the bail application filed by the petitioner stands dismissed.

However, the trial court is directed to decide the criminal case of the petitioner within six months from the date of receipt of certified copy of this order, in accordance with law.
