The instant 3^rd bail application has been filed under Section 483 B.N.S.S. on behalf of accused-petitioner in the matter arising out of F.I.R. No. 60/2021 registered at Police Station Sambhar, District Jaipur Rural for the offence(s) punishable under Section(s) 147, 148, 149, 302, 323, 447, 435 & 188 I.P.C., Section 51 of the Disaster Management Act, 2005 & Section 5 of the Epidemic Disease Act, 2020.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, he has nothing to do with the alleged offence(s) and he is behind the bars since 07.08.2021. Counsel further submits that the other co-accused person(s), namely Suresh Kumar has been granted bail by Honb'le Supreme Court vide order dated 02.08.2024 & Bhanwar Lal has been

granted bail by a Co-ordinate bench of this Court vide order dated 30.08.2024. Counsel further submits that the case of the present petitioner is similar to that of other co-accused persons. It is also submitted that no recovery has been affected from the petitioner and he has remained in judicial custody for a period of more than three years. There are contradictions in the statements of complainant, namely Mukesh Kumar, recorded under Section 161 Cr.P.C. & during trial. Trial of the case is likely to take a long time to conclude, till then, his further incarceration would not serve any fruitful purpose and he is ready and willing to furnish his bail bonds. Therefore, the bail application deserves to be allowed.

Learned Public Prosecutor and learned counsel for the complainant-respondent have vehemently opposed the bail application.

Heard learned counsel for the parties and perused the material available on record.

Taking into consideration the submissions put forth, overall facts & circumstances of the case, improvements made by the complainant in his statement(s) & custodial period of the petitioner but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioner on bail.

Therefore, the 3^rd bail application is allowed . Accusedpetitioner namely Rughnath S/o Late Shri Dhannaram, shall be released on bail, if he is not required in any other case, provided he furnishes a personal bond in the sum of Rs.50,000/(Fifty Thousand) together with two sureties in the sum of

Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any other court to which the matter is transferred, on all subsequent dates of hearing and as and when he is called upon to do so.
