1. This contempt petition has been filed on behalf of the petitioners alleging that the respondents have not complied with the directions given by this Court vide order dated 03.01.2022 passed in D.B. Civil Writ Petition No.17915/2021 (Man Singh & Ors. Vs. State of Rajasthan & Ors.) .

2. This Court vide order dated 03.01.2022 while disposing of DBCWP No.17915/2021 directed the respondents to decide the representation of the petitioners in the light of the directions given by this Court vide order dated 30.01.2019 passed in Jagdish

Prasad Meena & Ors. Vs. State of Rajasthan & Ors. (D.B. Civil Writ Petition No.10819/2018) within a period of six months from the date of receipt of the copy of that order.

Learned AAG has submitted that despite directions given by this Court, encroachments over the public land could not be removed as one aggrieved person has approached this Court by way of writ petition, wherein the learned Single Judge has passed the interim stay order for maintaining status quo.

4. Learned counsel for the petitioners has also verified that one of the alleged encroachers has approached this Court and stay order is operating in his favour. It is also submitted that the petitioners have also approached this Court for vacation of that stay order.

5. In view of the above facts and circumstances of the case, we are of the view that at this stage, the order dated 03.01.2022 passed by this Court in D.B. Civil Writ Petition No.17915/2021 (Man Singh & Ors. Vs. State of Rajasthan & Ors.) cannot be complied with by the respondents, therefore, no further order is required to be passed in this contempt petition.

6. Accordingly, this contempt petition is disposed of.

7. Notices are discharged.

¶26

8. However, the petitioners are free to approach this Court after conclusion of the proceedings initiated by the alleged encorachers before this Court.
