This contempt petition has been filed by the petitioner complaining that the respondents have not complied with the directions given by this Court vide order dated 01.10.2021 passed in D.B. Civil Writ Petition No.13602/2021.

This Court vide order dated 01.10.2021 disposed of D.B. Civil Writ Petition No.13602/2021 filed by the petitioner while observing that the respondents are expected to look into the representation

of the petitioner as per the directions given by this Court vide order dated 30.01.2019 passed in D.B. Civil Writ (PIL) Petition No.10819/2018 : Jagdish Prasad Meena & Ors. Vs. State of Rajasthan & Ors.

An interim compliance report has been filed on behalf of the respondents, wherein it is mentioned that the respondents identified as many as 34 encroachments over the public land and after initiating proceedings under Section 91 of the Land Revenue Act for removal of the said encroachments, orders were passed. It is further mentioned that several encroachments have been removed, however, some of the encroachments are of permanent nature and the same could not be removed because they are in existence from last 20 to 30 years.

It is clarified in the compliance report that some portion of the houses were found to be extended on the pasture land, which is right adjacent to the Abadi land, and on account of that some of the houses are extended on the gochar land. It is also submitted that certain public buildings such as Panchayat Bhawan, Schools, Bus Stand and Road are partially falling in the gochar land.

It is further mentioned in the interim compliance report that notices were issued to the remaining 17 encroachers to remove the encroachment on their own, however, when they failed to do so, the team of the revenue officials have removed the said encroachments except the land of the temple.

It is further mentioned that so far as the public way alleged to have been encroached is concerned, proceedings were initiated for the same, however, the affected persons have approached the

concerned court by initiating proceedings under Sections 131 and 136 of the Rajasthan Land Revenue Act, 1956, which is still pending consideration.

Having gone through the compliance report filed by the respondents, this Court is of the opinion that compliance of the directions given by this Court vide order dated 01.10.2021 passed in D.B. Civil Writ Petition No.13602/2021 has already been made, therefore, no further order is required to be passed in this contempt petition and the same is hereby disposed of.
