The order of learned Single Judge passed on 10.05.2023 disposing off stay application in the manner that the recruitment made shall be subject to final outcome of the writ petition is being assailed on the ground that the appellants had a very strong prima facie case, therefore, interim order ought to be granted by staying process of recruitment.

Learned counsel for the appellants would submit that the advertisement seeks to fill up posts by way of direct recruitment in excess of 50% quota as marked under the rules.

After going through the order of learned Single Judge, we are of the view that in the absence of there being clear pleadings with regard to total number of vacancies in the cadre, the appellants claim of having a strong prima facie case is not made out. Therefore, the order of learned Single Judge does not warrant any interference.

This appeal is, accordingly, dismissed.
