1 . The lawyers are abstaining from work on account of strike.

2 . The present application for bail has been filed by the petitioner under Section 439 of Cr.P.C. in connection with FIR No.476/2022 registered at Police Station Kuri Bhagtasani, Housing Board, District Jodhpur for the offences under Sections 420, 406 IPC.

3 . Ms. Laxmi, petitioner’s sister, present in person submits that petitioner has been falsely implicated in this case.

4 . Learned Public Prosecutor submits that the allegation levelled against the petitioner is to the effect that he has been taking money in installments from the two people on the pretext of making jewellery for them but he neither gave jewellery to them

nor returned their money. He further submits that charge-sheet has been filed.

5 . Heard representative of the petitioner and learned Public Prosecutor. Perused the material available on record.

6 . Looking to the entirety of facts and circumstances of the case and the submissions made by Ms. Laxmi, petitioner’s sister, present in person and the learned Public Prosecutor, I am of the opinion that the petitioner shall be enlarged on bail in this case.

7 . Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Sundar Lal S/o Kheta Ram shall be released on bail in connection with the aforesaid FIR; provided he executes a personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial court. The petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
